Terms of Use

1. Acceptance of Terms

By using the Rastron platform ("Service"), a product of TechSnap e.U., you ("Client," "you") agree to these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use our Service. These Terms constitute a binding legal agreement between you and TechSnap e.U.

2. Description of Service

Rastron is an online ordering platform that provides online ordering systems, menu management, customer management, and related services to help restaurants and food service businesses manage their operations.

3. User Accounts

To use our Service, you must create an account. You are responsible for providing accurate registration information, maintaining the security of your account, and all activities that occur under it.

4. Restaurant's Responsibilities to End-Customers

You are solely responsible for your relationship with your customers ("End-Customers"). This includes:

Terms and Privacy: You must provide your own legally compliant terms of service and privacy policy to your End-Customers.
Customer Service: You are responsible for all aspects of your offerings, including order fulfillment, cancellations, returns, refunds, and customer support.
Data Protection: You acknowledge that you are the Data Controller for the personal data of your End-Customers. We act as a Data Processor on your behalf, as detailed in our Privacy Policy.

5. Relationship with End-Customers

Our Service is a platform that enables you to do business with your End-Customers. TechSnap e.U. is not a party to any transaction between you and your End-Customers. We are not responsible for, and have no liability regarding, any disputes, issues, or claims that arise between you and them.

6. Acceptable Use

You agree to use our Service only for lawful purposes. You may not use the Service for illegal activities, attempt to gain unauthorized access to our systems, or engage in any activity that could harm our platform or other users.

7. Payment and Subscription Terms

Subscription Term: We may offer different subscription plans, such as monthly or annual terms. The specific details, including fees and the subscription term, will be stated at the time of purchase.
Fees: Fees for your chosen subscription plan are charged in advance for the upcoming term.
Price Changes: We reserve the right to change our fees. For existing plans, we will provide at least 30 days' notice of any fee changes.
Payment Methods: We accept credit cards, SEPA direct debit, and bank transfer.
Refunds: Subscription fees are non-refundable except as required by law.

8. Data Privacy and Processing

We are committed to protecting data. Our role as a Data Controller for our Clients and as a Data Processor for End-Customer data is fully detailed in our Privacy Policy. By using our Service, you agree to the terms of our Privacy Policy and acknowledge your responsibilities as a Data Controller.

9. Intellectual Property

We own all rights to the Rastron platform, including software, trademarks, and content. You retain all rights to your own content and data. We grant you a non-exclusive, non-transferable license to use our Service in accordance with these Terms.

10. No Agency or Partnership

No agency, partnership, joint venture, or employment is created as a result of these Terms, and you do not have any authority to bind TechSnap e.U. in any respect.

11. Service Availability

We strive to keep the Service available but do not offer Service Level Agreements (SLAs) for standard plans. We may interrupt the Service for maintenance and are not responsible for interruptions due to circumstances beyond our control (force majeure).

12. Termination and Cancellation

Termination by You (Cancellation):
- For Monthly Plans: You may cancel your subscription at any time with 30 days' notice to the end of the month.
- For Annual or other Long-Term Plans: If you have committed to a subscription for a specific term (e.g., annual), your subscription is non-cancellable for the duration of that term. No refunds will be issued for early cancellation.
Termination by Us: We may terminate your account for a violation of these Terms or for any other reason with 30 days' advance notice. If we terminate for convenience, we will refund any prepaid, unused portion of your subscription fee.
Effects of Termination: Upon termination, your access to the Service will cease. Unpaid fees remain due.

13. Separate Agreements

If you have entered into a separate Service Agreement with TechSnap e.U. for the Service, the terms of that agreement shall take precedence over these Terms of Use in the event of any conflict.

14. Limitation of Liability

To the fullest extent permitted by law, our Service is provided "as is". Our liability is limited to the amount you actually paid for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect damages or for any disputes arising from the transactions between you and your End-Customers.
